Can a private health insurer refuse to cover medical cannabis simply because it is not expressly included in the mandatory benefits package?

A recent decision by the Argentine Federal Courts answered that question in the negative.

Our firm represented a client with a severe congenital musculoskeletal condition and chronic pain, whose treating physicians prescribed both a medical cannabis treatment and specialised diagnostic studies aimed at improving her quality of life.

The health insurer denied coverage, arguing that the requested treatment fell outside the scope of the Mandatory Medical Programme (PMO).

The Court disagreed.

The Court’s Reasoning

In its judgment, the Court reaffirmed a key principle of Argentine health law: the PMO establishes a minimum standard of coverage, not a maximum limit. Consequently, the absence of a particular treatment from the PMO does not, by itself, justify denying coverage where there is a well-founded medical indication and fundamental rights are at stake.
