1.  General

360 Business Law is a trading division of 360 Business & Private Client Law Limited, a limited liability company registered in England & Wales under number 08884503. Its registered office is at Kemp House, City Road, London, England, EC1V 2NX and our principle place of business is at 366-399 London Road, Camberley, GU15 3HL. 360 Business & Private Client Law Limited is an unregulated law firm.

2.  Ethics and professional standards policy

360 Business Law is committed to the highest ethical and professional standards. These apply to all our people, regardless of role, and to all our offices. 360 Business Law people are required to act professionally and in compliance with all relevant laws and regulations.

These ethical and professional standards include:

  • acting with integrity, professionalism and fairness
  • acting in the best interests of each client, including providing a proper standard of service to our clients
  • upholding the rule of law and the proper administration of justice
  • behaving in a way that maintains the trust the public has in the provision of legal services
  • maintaining our independence

360 Business Law has internal policies intended to help its people comply with these standards and with relevant laws and regulations.

3. Unregulated Practice Complaints

The Legal Services Act 2007 was introduced to allow qualified Solicitors and Barristers to practice in un-reserved matters in an unregulated/unregistered manner. The Solicitors and Barristers at 360 Business Law act in this capacity to provide you with advice and legal services in a cost-effective manner. To enable our Solicitors and Barristers to practice in this manner we are required to make the following statement:

“Unregistered Barristers do not have a practising certificate and are not on the register of practising barristers. Therefore, in providing any legal services to you they are not acting as a barrister and are not subject to many of the rules which regulate practising barristers. This limits the services they can provide to you. They can provide you with legal advice and represent you before certain Tribunals but cannot exercise right of audience in Court. Solicitors undertake services through us as unregulated Solicitors. Our unregulated Solicitors do hold a practicing certificate, but chose to practice in an unregulated capacity. Therefore, in providing any legal services to you they are not acting as a Solicitor, but as consultant and are therefore not subject to Solicitor Regulation Authority rules relating to practising Solicitors.”

360 Business Law aim to provide you with an excellent service, but should you have any concerns or issues with any of our consultant lawyers, please send an email clearly setting out your complaint to our Compliance Officer for Legal Practice and we will try to resolve the problem. You should, however, know that you would have only limited rights to complain about any unregistered Solicitor or unregulated Barrister to anyone else. The Legal Ombudsman, who adjudicates on complaints about poor service by practising Solicitors and Barristers, cannot consider any complaint against unregulated Solicitors or unregistered Barristers. If we cannot resolve your concerns, you can complain to the Bar Counsel or the Solicitors Regulation Authority, as relevant, and they will investigate whether the unregulated Solicitor or unregistered Barrister has failed to comply with any of the rules which apply to unregulated Solicitors or unregistered Barristers but it cannot investigate possible breaches of rules which apply only to practising Solicitors or Barristers.

4. Anti-corruption statement

360 Business Law has a zero tolerance policy towards bribery and corruption. We are committed to:

  • conducting business in a manner that complies with applicable laws and is consistent with the highest ethical standards including, among other things, standards intended to prevent bribery and corruption, and
  • using our best endeavours to ensure that those who perform services for and on behalf of 360 Business Law Limited – including employees, contractors, foreign counsel and agents – are aware of and share our commitment to conducting business ethically.

360 Business Law is subject to the UK Bribery Act 2010 in respect of its activities throughout the world and has adopted an Anti-Corruption Policy, which has been endorsed by its senior management. The policy is based on an assessment by 360 Business Law of the external and internal bribery risks that face us, and reflects fundamental standards that 360 Business Law expects those who perform services for us and on our behalf to abide by when acting on our behalf.

360 Business Law will not use third parties or intermediaries to engage on its behalf in unethical practices that would be prohibited under any applicable laws if undertaken by 360 Business Law. 360 Business Law expects that all third parties and intermediaries that it engages will conduct themselves accordingly when acting on behalf or for the benefit of 360 Business Law. 360 Business Law is committed to transparency on its ethical standards and anti-bribery initiatives and has established procedures that are described in our Anti-Corruption Policy to encourage employees to report instances or allegations of policy violations.

5.  Data privacy

360 Business Law takes data privacy seriously. We have a global policy, that we follow worldwide, which is based on EU data protection principles.  For more information see our privacy guide.

6.  Anti-money laundering policies and procedures

Our anti-money laundering (AML) policies are generally based on the highest standards that are required in the jurisdictions where we operate, and apply in relation to all of our business worldwide. 360 Business Law conducts client due diligence enquiries on each new client and persons connected with them and conducts ongoing monitoring of existing clients. These enquiries are based on the FATF Recommendations, and the EU Third Money Laundering Directive, although if additional information is required by the local rules of any country where we are being asked to work, that information will also be obtained. Where necessary for these purposes, we seek relevant information from third party data suppliers. Where individuals have supplied personal data for this purpose we will only use it for that purpose and will keep it only as long as the relevant AML and data protection legislation requires.

360 Business Law also has internal procedures to ensure that any suspicions of money laundering are reported to the appropriate authorities where there is an obligation to do so. Consultant lawyers and other relevant staff are provided with training on these issues.

7. Human rights

The UN Guiding Principles on Business and Human Rights which were unanimously endorsed by the Human Rights Council in 2011 state that all business enterprises have a responsibility to respect human rights. As a company we have agreed to support and respect internationally recognised human rights, both as part of our commitment to the UN Global Compact and consistent with the UN Guiding Principles.

8. Slavery and human trafficking

360 Business Law opposes all forms of slavery and human trafficking, and is committed to taking steps to ensure that these do not occur in its business or in its supply chains.

9.  Complaints procedure

360 Business Law is committed to providing its clients with commercially focused legal advice of the highest quality.  Any client who is unhappy about the advice and assistance that it receives from the company, including any concerns about a bill, is entitled to complain.
